TERMS AND CONDITIONS/DISCLAIMER

1.     Bloom E-Riders provides access to electric bicycles for hiring by customers to be utilised on the mountain bike trails and fire roads provided by Coillte in the Slieve Bloom areas of Laois and Offaly.

 

2.     All bikes must be used in a reasonable and responsible way.

 

3.     The period of hire is the agreed time in which the bike will be used, failure to abide by this will result in the forfeiture of deposit until extra costs are recouped.  The period of hire shall be as follows:

 

October to March from 9.30am to 16.30pm

April to September from 9:30am to 18:00pm

 

The customer is responsible for the bike hired and must make every effort to avoid damage to the bicycle or it’s destruction or disappearance.

 

4.     The customer undertakes to inform Bloom E-Riders as swiftly as possible of the loss, theft, any accident or any other problem in relation to the use of the bicycle.  In any event the bicycle shall remain under the responsibility of the customer in accordance with these terms and conditions.

 

5.     The bicycle remains at all times the properties of Bloom E-Riders.  The customer is expressly forbidden to allow any third party to use the bicycle in any way whatsoever whether for free or for consideration.

 

6.     The service provided by Bloom E-Riders is also accessible to person’s aged 17 or over once the bicycles are hired by their Legal Guardian under the liability of the clause and in accordance with these terms and conditions.

 

7.     The customer is authorised to use the bicycle only in accordance with the terms hereof provided that such use is reasonable which excludes the following:-

 

a.      any use to the contrary to the provision of the rules of the road and current traffic regulations.

b.     any use on land or under conditions that are likely to damage the bicycle.

c.      the transportation of any passenger under any circumstances.

d.     any use of the bicycle causing damage to the customer or to third parties.

e.      any dismantling or attempt to dismantle all or part of the bicycles and or generally

f.      any abnormal us of the bicycle.

 

8.      Any goods carried by the customers either on their person or on the bicycle are at the sole risk of the customer.

 

9.     Damage to or the soiling of the customer while using the bicycle is at the sole risk of the costumer.

 

 

 

 

Customer Liability:

1.     The customer is fully and solely liable for any damage caused by the use of a bicycle during the hire period and including when the hire period is exceeded in the event of a later return by the customer.

 

2.     The parents or guardians of any minor children will be held liable for any damage caused directly or indirectly by the minor as a result of the use of Bloom E-Rider Service.

 

3.     A bicycle that has not returned after 4 hours of expiry since the end of hire period will be considered as a case of disappearance until the bike is found or returned.

 

4.     In the event of the disappearance of a bicycle for which a customer is liable the customer is obliged to inform Bloom E-Riders of this disappearance and to register the theft with An Garda Síochana immediately. The customer shall remain fully and solely responsible for the bicycle until it is returned or replaced at the customers cost

 

5.     In the event of an accident and/or incident involving the bicycle the customer is under obligation to immediately inform Bloom E-Riders of the facts as soon as is reasonably practicable.  The customer shall complete any and all documentation required by Bloom E-Riders in respect of any such accident and/or incident.  The customer remains liable for the bicycle until such time as it is handed over in person to a representative of Bloom E-Riders and have received their deposit back.  

 

6.     The customer declares that they are capable of using a bicycle and physically fit to do.

Helmets, elbow and knee pads are provided and we recommend their use at all times during the period of bike hire.  The use of alcohol and/or illegal drugs is strictly prohibited during the period of bike hire.

 

7.     As the customer is liable for the bicycle, prior to use, the bicycle should be inspected by the customer and the main visible working parts in particular but not limited to brakes, handle bars, gears, frames, seat adjustment, wheels and tyres.

 

8.     You the customer are not insured by the company to use the bicycle and you do so entirely at your own risks.   It is advised that you take out your own public liability insurance if you do not have such policy already in place.

 

9.     These conditions in use are subject to Irish Law, any dispute arising from the performance and consequence thereof shall be brought before the Courts of Ireland which the parties expressly attribute jurisdiction including in the event of summary judgements, introduction of third parties or numerous defendants.
